Troutman Sanders Represents Pacific Surf Designs in Successful Inter Partes Review Request
SAN FRANCISCO, Feb. 1, 2017 – Troutman Sanders recently advised its client Pacific Surf Designs, Inc. (“PSD”) in its request for inter partes review (IPR) against patents asserted by Surf Waves Ltd. (“Surf Waves”), a subsidiary of Whitewater West Industries, Ltd. (“WWI”), in litigation pending in the United States District Court for the Southern District of California.
On January 30, 2017, the U.S. Patent & Trademark Office (PTO) issued a Decision to institute the IPR, finding that PSD’s petition “establishes a reasonable likelihood that [Pacific Surf Designs] would prevail in showing challenged claims 1-20 unpatentable” on each of the five separate grounds advanced in PSD’s petition.
In the same litigation, PSD has filed another petition for inter partes review against a patent asserted by Flowrider Surf Ltd, also a subsidiary of WWI, and is awaiting a decision from the PTO.
