Meagan Mihalko is an associate in the Financial Services Litigation practice. Meagan’s practice is principally devoted to financial services and business litigation. Meagan represents clients in both state and federal court at both the trial and appellate level. Meagan's financial services litigation experience includes the defense of class action and individual matters involving federal consumer protection statutes such as the Fair Credit Reporting Act, the Fair Debt Collections Practices Act, the Equal Credit Opportunity Act and the Telephone Consumer Protection Act. Meagan has litigated cases in federal courts around the country including the Northern District of Alabama, the District of Arizona, the District of Connecticut, the Northern District of Georgia, the District of Hawaii, the Western District of Kentucky, the Western District of Missouri, the District of New Jersey, the Eastern and Southern Districts of New York, the Middle District of Tennessee, the Eastern and Western Districts of Virginia and the Eastern District of Wisconsin,

Meagan works with clients to assess the value and risk of each case and to develop a strategy consistent with the client’s goals. Meagan handles all aspects of federal and state court litigation, including discovery, dispositive and non-dispositive motions practice, trial, mediation, and appeals.

  • Counsel for one of the largest banks in defense of putative FCRA class actions arising out of hiring processes and obtained summary judgment in federal court.
  • Counsel for national reseller of consumer reports in defense of putative class action and single-plaintiff FCRA cases. Obtained summary judgment and partial summary judgment of FCRA claim in federal court.
  • Counsel for regional bank in defense of single-plaintiff FCRA claim.
  • Counsel for national debt buyer in defense of putative class action and single-plaintiff FDCPA cases.
  • Counsel for national debt collector in defense of putative class action and single-plaintiff FDCPA and TCPA cases.
  • Counsel for staffing agency in putative class action FCRA case.
  • Counsel for national background screening company in FCRA national class action and single-plaintiff FCRA cases.
  • Counsel for automotive finance company and obtained dismissal with prejudice of FCRA claim in federal court.
  • Counsel for regional insurance company in TCPA class action and obtained stay of litigation in light of Campbell-Ewald Co. v. Gomez and Spokeo, Inc. v. Robins.
  • Represented manufacturing company in “junk fax” case and obtained dismissal with prejudice in federal court.
