Chemicals, Pesticides, and Product Regulation

The Environmental Protection Agency (EPA) is in the process of enhancing its current chemical management program. These changes will have significant implications for companies registering new chemical products or seeking to expand registrations for existing chemical products in the United States and internationally. Troutman Sanders’ Environmental and Natural Resources practice includes an experienced team of lawyers focused on chemicals, pesticides and related product regulation and we help clients ensure compliance with the full range of regulatory schemes governing the production, storage, transportation, use and disposal of products. We also actively work with our clients and industry consortiums to advocate policy changes in several states.

Among other federal laws, regulations and initiatives, we advise clients on the Toxic Substances Control Act (TSCA), the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), the Clean Air Act (CAA) Risk Management Plan program, the Department of Homeland Security Chemical Facility Anti-Terrorism Standards (CFATS), the Department of Transportation Hazardous Materials regulations, as well as state and international chemical regulatory programs, including Proposition 65 in California, various states’ Green Chemistry initiatives, and the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) regulation in Europe.

Our broad experience with these and many other international, federal and state chemical regulatory programs allows us to provide an integrated approach to the regulation of chemical substances throughout the supply chain.
