Brownfields and Voluntary Cleanup

Redevelopment efforts such as the Environmental Protection Agency’s Re-Powering America’s Land Initiative are bringing a renewed focus to the use of brownfields and voluntary cleanups. In recent years, private- and public-sector groups have converted previously abandoned and unused brownfield properties into viable commercial, retail and residential sites. As a further incentive to businesses and organizations, the EPA’s Brownfields Program offers grants and other funding for the assessment and cleanup of such sites.

We represent purchasers, sellers, long-term tenants, lenders and equity investors in transactions involving contaminated properties throughout the United States. Our lawyers have assisted many clients in availing themselves of the liability protections and incentives offered pursuant to federal and state brownfields programs and state voluntary cleanup programs.

In addition, our lawyers have played significant roles in the development of brownfields laws and policies in multiple states. We have assisted in the passage and amendment of state laws designed to encourage brownfields redevelopment and voluntary cleanup of sites.

Representative Experience

  • Assisted in the purchase and sale or long-term leases of environmentally challenged sites in NC, SC, FL, AZ, and CA.
  • Assisted a national fast food chain in enrolling site into and completing multiple state programs, including the Texas Voluntary Cleanup Program; Tennessee Voluntary Cleanup, Oversight and Assistance Program; Pennsylvania Voluntary Cleanup Program; Maryland Voluntary Cleanup Program; North Carolina Voluntary Cleanup Program; Wisconsin Voluntary Party Liability Exemption; Colorado Voluntary Cleanup and Redevelopment Program; and the Illinois Site Remediation Program.
  • Assisted in the investigation and remediation of a former chemical-manufacturing facility through the Georgia Voluntary Remediation Program. We also participated in the preparation of the property for eventual sale through the Georgia Brownfields Program.
