Angela Levin is a member of the Environmental and Natural Resources practice. She assists clients with regulatory counseling, policy development, and enforcement under a range of environmental laws, with a focus on the Clean Air Act and state counterparts as well as management of retail and chemical products under California’s Prop 65, the Toxic Substances Control Act, and the Resource Conservation and Recovery Act. Her practice also includes counseling clients on the environmental issues associated with project development and acquisition, including significant experience advising utilities, lenders, and developers on the environmental considerations that arise with utility-scale renewable energy project development, including assessment of species impacts under the Endangered Species Act, the Migratory Bird Treaty Act, and the Bald and Golden Eagle Protection Act and compliance with the National Environmental Policy Act and the California Environmental Quality Act.

Representative Matters

Policy Development

  • Represent utilities and coordinate with advocacy groups and trade associations to influence and inform legislative and regulatory developments, including EPA’s Greenhouse Gas standards for new electric generating units and for existing units (the Clean Power Plan)
  • Assist retail companies in furthering efforts to reform state and federal retail waste regulations, including applicability of the California Medical Waste Management Act to over-the-counter pharmaceuticals
  • Develop comments on proposed listings of endangered and threatened species as well as programmatic U.S. Fish and Wildlife Service rulemakings, including the
  • Assist clients with assessing the impacts of regulatory developments under the Endangered Species Act and the Bald and Golden Eagle Protection Act, including the listing of the northern long-eared bat and the associated 4(d) exemption rule and the recent revisions to the Eagle Take Permit regulations
  • Counsel clients on the development and implementation of TSCA reform under the Frank R. Lautenberg Chemical Safety for the 21st Century Act

Regulatory Experience

  • Advise companies on compliance with National Emission Standards for Hazardous Air Pollutants standards under the Clean Air Act, including the Mercury and Air Toxics Rule
  • Counsel retail consumer product and pharmaceutical companies on retail waste management requirements under the Resource Conservation and Recovery Act and state counterparts
  • Advise utilities and manufacturers on Clean Air Act pre-construction permit requirements under the New Source Review and the New Source Performance Standards programs;
  • Assisted wood products coating facility in obtaining air permit from San Joaquin Air Pollution Control District for natural-gas fired boiler and direct-fired kiln
  • Represent utilities in obtaining PSD permits for Greenfield natural gas combined cycle facilities
  • Represented utility in obtaining synthetic minor air permit for conversion of coal-fired boilers to natural gas
  • Counseling client on the applicability of incidental take permitting under the Bald and Golden Eagle Protection Act for an operating wind facility
  • Advise chemical manufacturers on compliance with the Toxic Substances Control Act as well as the applicability of exemptions to TSCA such as the polymer, test marketing, and research and development exemptions
  • Counsel clients on negotiation and scope of remediation obligations under CERCLA and state counterparts, as well as entry into Brownfield programs, for groundwater and soil impacts at commercial and industrial properties in California, Georgia, North Carolina, New Jersey, and Virginia

Transactional Experience

  • Serve as environmental counsel for southeastern utility in acquisition of over 2000 MW of solar and wind power generation facilities in California, Georgia, Oklahoma, Maine, and Texas, including issues arising under the National Environmental Policy Act, the California Environmental Quality Act, the Clean Water Act, the Endangered Species Act, the Migratory Bird Treaty Act, and the Bald and Golden Eagle Protection Act
  • Represented clients in assessing species-related risks and considerations for project development in California, Texas, Oklahoma, North Dakota, Maine, Georgia, Florida, North Carolina, West Virginia, Virginia, and Pennsylvania, including assessment of impacts to the burrowing owl, San Joaquin fox, Mojave ground squirrel, Swainson’s hawk, desert tortoise, gopher tortoise, black-capped vireo, whooping crane, northern long-eared bat, Indiana bat, and bald and golden eagles
  • Represented lender in environmental due diligence for acquisition of utility-scale photovoltaic solar projects in Arizona and California
  • Counseling natural gas utility on air quality and species considerations associated with development of multi-state natural gas pipeline project
  • Represented ethanol manufacturer in acquisition of five ethanol production facilities in Illinois and Nebraska
  • Advising utility on development of combined cycle facility in California, including nonattainment air quality and Greenhouse Gas considerations
  • Represented chemical manufacturer in the sale of a chemical manufacturing facility in Georgia, including entry of the site into Georgia’s Brownfield program

Enforcement and Litigation

  • Represented major southeastern utility in defending an EPA Clean Air Act New Source Review enforcement action
  • Represented national retailer in resolution of alleged violations of California hazardous waste regulations and development of comprehensive compliance strategy
  • Assisted client with negotiation of consent order with San Joaquin Air Pollution Control District regarding unpermitted use of portable diesel generators
  • Represented chemical manufacturer during EPA audit and assisted with negotiation of consent order for alleged TSCA reporting violations discovered during the audit, including successful dismissal of allegations regarding failure to submit substantial risk information to the agency under TSCA Section 8(e)
  • Assisted manufacturer with responding to citizen group Prop 65 notice of violation for heating and air conditioning components
  • Assisted pesticide manufacturer with responding to EPA information request regarding alleged failure to register a pesticide under FIFRA
  • Assisted chemical manufacturer in responding to allegations of violations of Clean Air Act Section 112(r) Accidental Release Prevention Requirements and revising Risk Management Plan
