Washington partner garners multiple press mentions and is lauded by U.S. Senator

May - June 2010

Washington, D.C., partner Peter Glaser obtained press in four different publications in May and June.

In a May 13 SNLEnergy article and a May 26 Industrial GHG Solutions magazine article, Glaser discussed different aspects about the recently passed EPA final “tailoring” rule that targets greenhouse gas emissions from power plants and other large stationary sources.

In the Industrial GHG Solutions article, Glaser questions the ability of the rule to withstand legal challenges. “I think the EPA is counting on nobody challenging it, because I think the legal rationale for what they’re doing is highly questionable,” he said. “I think the rationale got legally less defensible in the final rule as opposed to the proposed rule.”

In a May 19 Politico article, Glaser was quoted about the fact that despite the massive BP oil spill in the Gulf of Mexico, several recent polls show that a majority of Americans still support further offshore drilling and exploration for domestic oil and gas.

“I think there’s a difference between talking about the public at large and the public” living in areas affected by the oil spill, he said. He also stated that he believes the oil spill will put an extra layer of difficulty into the recently unveiled climate change legislation.

Glaser was cited in remarks made on the Senate floor by Senator James Inhofe during the June 10, 2010, debate of the Murkowski Resolution to disapprove EPA's endangerment finding and prohibit EPA regulation of greenhouse gases under the Clean Air Act.  Senator Inhofe is the ranking minority member of the Senate Committee on Environment and Public Works.

"Peter Glaser, an attorney with Troutman Sanders, and one of the foremost Clean Air Act attorneys in the country," said Inhofe, "[stated] that EPA’s endangerment finding will lead to federal regulation of schools, hospitals, nursing homes, commercial buildings, churches, restaurants, hotels, malls, colleges and universities, food processing facilities, farms, sports arenas, soda manufacturers, bakers, brewers, wineries, and many others."

Additionally, Glaser was quoted a number of times in a June 10 Law360 article regarding the Senate’s rejection of the Murkowski Resolution and the future implications of the EPA’s regulation of greenhouse gas emissions.

“[EPA's] public view will be full speed ahead, but...they're still dealing with this underlying problem that the statute doesn't really fit what they're trying to do,” he said.
