Washington of counsel discusses case that could be the first of its kind

Transportation deputy practice group leader and Washington of counsel Len Fleisig was quoted in an April 21 Law360 article about a case that could be the first of its kind – the Fresno-Yosemite International Airport suing the U.S. government for about $1 million over alleged double billing for three customs officers contracted to work at the airport.

In the article, Fleisig, who represents the city of Fresno in the case, said that while larger airports have a different arrangement, midsize airports such as Fresno-Yosemite that want to have international flights have to pay a fee to Customs for the officers they use.

Fleisig said that he’s not aware of any similar contract dispute that has been litigated before the U.S. Court of International Trade. “I haven’t found anything that seems remotely like a precedent for this,” he said. “It does seem to be a first of its kind.”
