Shanghai managing partner Edward Epstein garners multiple mentions in Asian press

Shanghai managing partner Edward Epstein was quoted in a December China Law & Practice article about the People’s Republic of China Anti-monopoly Law spawning a vast amount of analysis, debate and hand-wringing among lawyers, academics and businesses worldwide. In discussing China’s State Administration of Industry and Commerce’s (SAIC) purposed rules to regulate the prohibition of abuse of dominant market position, monopoly agreements and administrative powers, Epstein stated, “It’s fair to say the SAIC regulations are likely to become law in 2010.”

Epstein was also quoted in a January 7 Financier Worldwide article about how Australasian countries have proved to be a bit more resilient than other economies across the globe in regards to weathering the current economic downturn. In discussing “caution” as a key for businesses to use when considering merger and acquisition deals in China, the article explained that foreign investors should have a good understanding of the Unfair Competition Law, the Consumer Interests Protection Law, the Price Law, as well as China’s Anti-Monopoly Law, which came into force in 2008.

Epstein stated, “Since the relevant new laws and regulations came into effect, there have been 58 concentration review filings, of which the MOC (Ministry of Commerce) has reviewed 46. Only one of them, the proposed acquisition by Coca-Cola of China’s largest fruit juice manufacture, has been prohibited. Another five have had restrictions imposed on them.”
