Scott’s extensive knowledge of the legislative and regulatory processes offers both attorneys and clients insight on issues involving international trade, export control and compliance, foreign direct investment in the United States, and aviation and maritime regulatory matters.

Representative Experience

Legislative/Regulatory

Assists attorneys in representing clients’ interests before Congress, Executive Branch departments, and federal regulatory agencies, as well as in related litigation and appellate work.

Monitors and tracks legislation and regulatory proceedings, conducts in-depth research and analysis on clients' behalf, prepares briefing papers and Congressional testimony, and attends hearings and regulatory proceedings.

Advises clients on compliance with required filings under the Lobbying Act, the Foreign Agents Registration Act, the Ethics-In-Government Act, and Federal Election Campaign Laws.

Export Control and Compliance

Assists attorney and clients on international trade matters involving trade in defense articles and services (Department of State - ITAR), dual-use export controls (Department of Commerce - BIS), foreign assets control and U.S. trade embargoes (Department of the Treasury - OFAC).

Experience in this area includes classification of items for export, analysis of export licensing needs, employment of foreign nationals, deemed export review and advice, voluntary self-disclosures and other export enforcement matters, Technical Assistance Agreements, advice and development of internal corporate export compliance programs.

Experience encompasses a wide range of industries, including satellite services, aerospace, defense manufacturers, mechanical and fatigue test system services, and telecommunications and energy producers.

International Trade

Assists attorneys and clients on international trade matters and disputes in Section 301 (unfair trade acts, policies and practices of foreign entities), Section 332 (general fact-finding investigations into trade and tariff matters), antidumping and countervailing duty proceedings, and other unfair competition matters.

Assisted attorney in a Section 337 (trade remedy investigation for intellectual property infringement) before the U.S. International Trade Commission.

Assists attorneys and clients on NAFTA bi-lateral trade matters, including dispute settlement proceedings and appeals before NAFTA panels.

Assists in factual analysis and due diligent reviews of mergers, acquisitions, takeovers or other foreign direct investment in U.S. corporations by foreign entities. This includes filings and proceedings before the Committee on Foreign Investment in the U.S. (CFIUS) for approval of foreign entities control over U.S. companies.

Transportation

Provides advice and analysis to numerous maritime clients on maritime pollution issues, including ballast water, oil pollution, air emissions, at both the state and federal level legislative and regulatory bodies.

Assists attorneys and clients on various maritime regulatory issues, proceedings and rulemakings before the U.S. Coast Guard, Maritime Administration, Federal Maritime Commission, the National Oceanic and Atmospheric Administration, and the Environmental Protection Agency.

Assists attorneys in matters involving U.S. Department of Transportation rules, policies, and procedures, and bilateral and multilateral aviation agreements, including the Warsaw, Montreal, and Chicago Conventions. This includes analysis and advice on the current legislative and regulatory environment.

Experience encompasses a wide range of sectors, including maritime shipping lines, express air delivery services, marine insurers, U.S. and foreign passenger air carriers, and offshore rig and supply companies.
