Real Estate Workout and Creditors' Rights
The Troutman Sanders Real Estate Workout and Creditors' Rights Group represents lenders, other capital providers and borrowers in connection with the workout, restructuring and remedy enforcement of all types of credit arrangements secured by real estate, including representation in forbearance agreements, foreclosures, receiverships, sureties, insurance, restructurings, income taxation, litigation and bankruptcy associated therewith, as well as planning and advice with respect to creative workout structures with lenders, borrowers, sureties and guarantors, including negotiating, structuring and securing deficiency settlements. Members of the group, drawing upon the expertise of attorneys in other key support areas, have legal expertise in real estate, lending, securities, insurance, income taxation, business entities, bankruptcy, government affairs, land use and environmental law, especially as those disciplines relate to credit transactions secured by real estate.
Clients of the group include several of the largest national banks in the U.S. and a number of state banks, foreign banks, life insurance companies and sureties, as well as borrowers that we have represented in transactions throughout the country, including large multi-state, multi-party transactions. We have also represented clients in the acquisition of distressed real estate and distressed real estate loans.
