Recent Victory: Troutman Sanders LLP International Trade Group Team Wins Unanimous Victory at the International Trade Commission on behalf of the Chinese Industry

On November 6, 2009, the US International Trade Commission voted unanimously that there was no material injury or threat of material injury to the US producers, ICL Performance Products LP and Prayon, Inc. (“petitioners”) from imports of Sodium Tripolyphosphate (STPP) from China which petitioners alleged were sold at less than fair value, i.e., “dumped”, and benefitted from Chinese government subsidies prohibited under the U.S. countervailing duty (CVD) laws. Troutman Sanders represented the Chinese industry and the largest producer and exporter of STPP, Hubei Xingfa Chemicals Group Co., Ltd. (“Xingfa”). As the result of this victory, Xingfa will be able to continue to export STPP free of dumping and CVD duties. In addition, because Troutman Sanders’ victory occurred at the preliminary stage of the investigation, the entire investigation will be terminated immediately as to STPP. This is the second unanimous ITC ruling the Troutman Sanders International Trade Team has won this year for clients
