New York attorney on the nature and enforcement of IP rights in China

New York partner Al Jacobs had his article “Will the US Soon Be Out-Innovated By China” published online June 1 by Law360.

 

Jacobs’ article states that while China has long held a reputation as a country that counterfeits or “knocks off” the goods of others, three recent developments are set to radically change this. First, the recent “Buy China” policies that China recently passed mandating local governments purchase products developed within the country. Second, China’s rapidly and decisively developing intellectual property system that’s aimed at promoting innovation. Third, the Chinese government “aggressively pushing innovation, innovation, innovation through all channels (businesses, government, schools and universities)…to produce momentum toward one goal….”

 

“…China’s push toward innovation will undoubtedly have beneficial consequences,” argued Jacobs. “By fostering growth and helping to move Chinese companies from emulators to innovators, China may begin to produce a new generation of companies who will inject innovation and capital into the world’s economy.”
