Nathan represents corporations, financial institutions, investment firms, and individuals in all aspects of criminal investigations and litigation, both pre- and post-indictment, as well as in complex civil litigation, including class, shareholders, and whistleblower actions in federal and state courts.

Nathan's practice focuses on the representation of corporate and individual clients in criminal grand jury investigations and prosecutions, internal investigations, regulatory inquiries and enforcement matters, and related parallel civil proceedings. Mr. Muyskens has represented clients before the Department of Justice, the Securities and Exchange Commission, The Federal Trade Commission, the National Association of Securities Dealers, the Department of Defense, the United States Congress, and other federal and state regulators. He has also conducted numerous internal investigations, advised with respect to corporate governance issues, and been involved in the implementation of compliance codes.

Nathan has particular expertise in counseling and defending clients involved in government antitrust investigations in a variety of industries, such as defense, energy, pharmaceuticals, chemicals, home products, and technology. He also represents clients in all types of civil antitrust litigation on both the federal and state levels. Nathan also dedicates a portion of his practice to providing antitrust compliance training and advice.

Before entering private practice, Nathan was a trial attorney with the Bureau of Competition of the Federal Trade Commission where he led investigations into the retail and energy sectors. Prior to his service at the Commission, Nathan served as an Associate Independent Counsel in the Office of Independent Counsel in re A. Michael Espy, which investigated and prosecuted several high-ranking officials of the U.S. Department of Agriculture. Nathan also served as Counsel to Senator Robert J. Dole in the United States Senate from 1995 to 1996.

Special Investigations

Represents a publicly traded global equipment manufacturer in a U.S. Department of Justice/ Securities and Exchange Commission investigation relating to alleged illicit foreign payments in the U.N. Oil for Food program.

Represents a major foreign air carrier in the U.S. Department of Justice’s investigation into alleged price-fixing in the air cargo industry.

Represented an executive in a U.S. Department of Justice/ Department of Defense investigation into alleged export control violations relating to an experimental weapons system.

Represented major manufacturer of home products in U.S. Department of Justice grand jury investigation into alleged violations of the Sherman Act.

Represented former CFO of a technology company in criminal and securities regulation matters brought by the Northern District of California United States Attorney’s Office and the Securities and Exchange Commission.

Represented employee of a high-tech company in an obstruction of justice investigation conducted by the U.S. Department of Justice.

Represented a manufacturer of highway products in U.S. Department of Justice Antitrust Division bid-rigging investigation.

Represented former CEO of a consumer electronic supplier in a U.S. Department of Justice investigation into alleged price fixing.

Represented former vice president of a petrochemical company in a U.S. Department of Justice investigation into alleged price fixing in the specialty chemicals market.

Represented a major asset management company in a Securities and Exchange Commission investigation into alleged misconduct in the annuities market.

Represented a mutual fund company in investigations by the Securities and Exchange Commission and the New York State Attorney General’s Office related to market timing issues.

Antitrust

Represented a manufacturer of generic drugs in a Federal Trade Commission investigation into violations of the Sherman Act and the Federal Trade Commission Act in connection with anticompetitive conduct concerning children’s over-the-counter cold medicine.

Represented a healthcare organization in a U.S. Department of Justice investigation into alleged monopolization, tying, and group boycott claims. 

Represented a trade association in a multi-district class action litigation involving alleged Sherman Act and Clayton Act violations in the wood products industry. 

Represented a pharmaceutical company in an antitrust class action related to alleged price fixing of primary ingredients contained in over-the-counter cough medicines.

Represented a natural gas pipeline company in a Federal Trade Commission investigation into alleged violations of the Federal Trade Commission and Clayton Acts.
