Milind has litigated complex insurance coverage cases, commercial disputes and tort claims in state and federal courts throughout the United States. He has also participated in mediations and other forms of alternative dispute resolution proceedings. His experience includes all facets of litigation from pre-suit investigation through trial. Milind has also argued numerous summary judgment motions in state and federal courts.
In his insurance practice, Milind has represented insurers in a variety of insurance coverage litigation and claims disputes. His practice includes advising clients in a broad range of insurance coverage issues, including environmental and mass tort matters, asbestos bankruptcies, complex corporate history and successor liability issues, as well as advertising injury and personal injury claims. In commercial and tort matters, Milind has represented a variety of companies involved in business torts and contractual disputes, product liability and other general negligence claims.
Representative Experience
Represented insurer in coverage litigation involving an advertising injury claim and successfully settled for a fraction of what the insured was seeking.
As co-counsel, resolved a 15-year asbestos coverage dispute involving thousands of asbestos claims in Delaware state court.
Represented a transportation company in breach of contract dispute with a Big-Three automaker
Represented insurer in coverage litigation involving claims made by a health insurance company under a professional liability policy with respect to a multi-million dollar class action settlement
Represented insurer in a non-products coverage dispute in coverage litigation and as co-counsel in a “pre-packaged” asbestos bankruptcy.
Successfully represented insurers in objection to debtor’s bankruptcy plan to settle asbestos claims though the vehicle of a Section 524(g) asbestos trust.
Advised clients on several matters involving whether present-day entities are entitled to coverage under general liability policies issued to alleged predecessor companies.
Obtained favorable settlements in several coverage disputes involving underlying asbestos claims and environmental contamination.
Obtained summary judgment ruling that policyholder must participate in defense and indemnification costs on a pro rata basis, and must reimburse the insurer for defense costs advanced on its behalf.
Represented insurer in a coverage dispute with a Big-Three automaker regarding company-wide class action employment discrimination and wrongful termination claims.
Represented insurer in a coverage dispute with a baseball bat manufacturer with respect to an antitrust claim brought by a competing manufacturer.
Represented insurers and self-insurers in several first party cases in which plaintiffs sought automobile no fault benefits.
Represented pension, health and welfare, and other fringe benefit plans in benefit dispute cases, ERISA collection actions, and cases involving fiduciary issues.
