Representative Experience
Lead counsel for Mariel Class Action suit to obtain permanent residency. INS had taken no action on nearly 100,000 pending permanent residency applications; filed suit to have INS ordered to adjudicate these applications. After negotiations and litigation, INS consented and adjudicated the applications (exclusive of criminal and mentally ill applicants).

Petition for Certiorari to U.S. Supreme Court in Duncan v. INS. Prepared petition and brief on novel immigration issues regarding ineffective assistance of prior counsel and whether a certain criminal statute fell within applicable grounds of deportability.

Petition for Review to the Eleventh Circuit Court of Appeals on Majothi v. INS (November 1996) testing the sufficiency of proofs in the de novo review of I-751 Conditional Residency cases.

Petition to the U.S. District Court for the North District of Georgia, successfully challenging on retroactivity and due process grounds (November 1997-1999).

Petition to the U.S. District Court for the Northern District of Georgia, challenging unlawful detention and denial of § 212 (C) waiver (September 2001-present).

Defense of various employer sanctions and anti-discrimination claims under IRCA.
