Various Environmental Acts
Counsel to a large municipality in Virginia, and other local jurisdictions in the ongoing effort to develop the King William Reservoir public water supply project. While securing all required state and federal permits, we have addressed issues under the National Environmental Policy Act (NEPA), the Clean Water Act (CWA), the National Historic Preservation Act (NHPA), the Coastal Zone Management Act (CZMA), the Endangered Species Act (ESA), the Virginia State Water Control Law, the Virginia Submerged Lands Act and other state laws, and the Treaty at Middle Plantation made with Virginia Indians in the year 1677. We have successfully defended challenges to the state permits and expect litigation challenging the federal permits, and we are defending common law claims based on the Treaty at Middle Plantation.
