Water Rights
Sample representations include:
- Drafting portions of the Apalachicola/Chattahoochee/Flint and Alabama/Coosa/Tallapoosa interstate compact; we were involved in contentious negotiations regarding those compacts on behalf of a citizen group;
- Representing a manufacturing trade association in lobbying against a statutory alteration of the common law of riparian rights and public trust doctrine to make all waters in Georgia subject to the public trust doctrine;
- Representing a large municipality in a class action suit against all riparian land owners on the Roanoke River in North Carolina seeking a declaration that the city's public water supply withdrawal would not injure downstream riparian land owners, including issues involving equitable apportionment of water rights among states.
