Environmental Insurance
We have found that the frequently one-size fits all approach of environmental insurance is not always cost-effective for our clients; we regularly review policies on behalf of our clients to ensure they are tailored to their needs. We have assisted real estate developers and investor-owned utilities in obtaining coverage for environmental cleanups.
Sample representations include:
- Assisting real estate developers in obtaining comprehensive environmental policies related to the purchase of land by reviewing insurance policies to ensure they meet the client's needs regarding protection from third-party suits and remediation costs;
- Representing clients in disputes with insurers regarding coverage for environmental harm to clients' property and for environmental harm caused by clients;
- Representing a client identified as an owner/operator of a site, successfully obtaining coverage for an environmental cleanups and defense costs;
- Representing a property owner who was a named insured on a Comprehensive General Liability policy issued in the early 1970s. EPA brought an action against our client as Potentially Responsible Parties (PRP) under Superfund. The insurer denied coverage initially, but ultimately reimbursed our client for legal defense costs; and
- Representing clients in disputes with insurers regarding coverage for environmental damage to clients' property and off-site property, and worked with insurance carriers on coverage claims.
