Single asset construction loans, project-based construction loans, borrowing base loans, lines of credit, term loans

The Firm’s real estate finance attorneys represent lenders, other capital providers and borrowers in connection with construction loans, bridge loans, term loans, permanent loans, revolving lines of credit and other credit arrangements secured by real estate. A given transaction may involve a single property or may involve multiple properties located in the Southeast or in other parts of the country. The Firm has expertise in real estate law, lending law, bankruptcy law, environmental law, corporate, partnership and limited liability company law and tax law, especially as those disciplines relate to credit transactions secured by real estate.

Representative Experience

  • Representation of a national bank, as agent for itself and other lenders, in regard to syndicated construction financing in the aggregate amount of approximately $147 million secured by a multi-use facility located within air rights over a former brownfield site in Metro Atlanta.
  • Representation of a national bank, as agent for itself and other lenders, in regard to syndicated construction financing of high-rise multi-family rental properties with option for submission to condominium.
  • Representation of a national bank, as agent for itself and other lenders, in regard to syndicated revolving and term loan facilities for a REIT secured by office properties in numerous jurisdictions.
  • Regular representation of a national bank in the consummation of construction loans secured by properties located throughout the country, including industrial, office, retail, hotel, multi-family and congregate care living facility properties.
  • Representation of a lender in a $70 million construction loan for regional shopping center in North Carolina.
  • Representation of a lender in a $94 million permanent loan for office building in Atlanta, Georgia.
  • Representation of regional bank in preparation of form loan documents for use in all commercial real estate loans in the state of Georgia.
  • Representation of a lender in connection with a $40 million loan for the construction of a Hilton Hotel near BWI airport, in Anne Arundel County, Maryland.
  • Representation of a lender in connection with a loan for the construction of buildings in Prince George's County, Maryland containing office and warehouse space.
  • Representation of a lender in connection with a loan for the construction of a skilled nursing facility in Baltimore County, Maryland.
  • Representation of a lender (also the administrative agent for all of the lenders) providing asset-based working capital financing to a group of affiliated companies in the business of manufacturing and selling various building materials.
  • Representation of a lender (also the administrative agent for all of the lenders) providing asset-based working capital financing to a supplier of materials for the manufacture of various electronic goods.
  • Representation of the Bank in connection with a working capital line of credit to National Aquarium in Baltimore.
  • Representation of the Bank in connection with a liquidity line of credit to support tax-exempt commercial paper notes issued for The Johns Hopkins Hospital.
  • Representation of the Bank in connection with the conversion of the remaining balance of an expired line of credit for the owner of a skilled nursing facility to a term loan.
  • Representation of the Bank since 1982 in construction lending secured by properties in North Carolina, including project based construction loans.
  • Representation of a life insurance company in term loans secured by properties in North Carolina.
  • Representation of a lender in Islamic law (Shari’a) Compliant Financing, permanent loans – counsel to life insurance company in connection with permanent financing of a Shari’a-compliant structured facility.
  • Representation of a life insurance company in connection with the financing of a warehouse facility placed in a PILOT program as part of a sale-leaseback transaction.
  • Regular representation of national banks in connection with the construction financing of multi-family developments all or a portion of which are to be submitted to condominium form of ownership.
