Dan has represented clients in general litigation matters, both simple and complex. He is also very active in the firm's insurance practice, providing coverage advice, monitoring actions and litigating complex coverage matters.
Representative Experience
Represented relators in novel False Claims Act case that obtained $76.25 million in recoveries based upon allegations of price fixing for carbon fiber. This action was also settled on very favorable terms for both the relators and the Government.
Represented insurer who had denied coverage based on late notice of claim. Obtained summary judgment on behalf of client in the bad faith lawsuit brought by the insured when the court found that the insurer’s policy language imposed a valid and enforceable reporting requirement.
In Medill v. Westport Ins. Corp., 143 Cal. App. 4th 819 (2006), successfully defended through appeal a bad faith, breach of contract and declaratory relief case brought against client in connection with several insureds’ attempts to seek coverage for an alleged “ponzi” scheme that resulted in the collapse of more than $130 million in bond issuances. The reported California Court of Appeal opinion is oft-cited in connection with numerous insurance coverage issues.
