- Serve as senior legal and policy advisor to Chairman Joseph Kelliher (R) recommending action on all high level policy matters and controversial adjudications within the agency’s jurisdiction (e.g., wholesale bulk power and electric transmission, natural gas markets and oil pipelines).
- Act as Chairman’s point person in all meetings with regulated entity CEOs and General Counsels.
- Manage Commission staff regarding implementation of Chairman Kelliher’s policies, including the successful implementation of Congressionally-required action on all Energy Policy Act of 2005 rulemakings and concomitant adjudications.
- Act as group leader of Chairman’s senior staff and preside over meetings of same.
- Responsible for all business and operational aspects of running the agency, including resource allocation and budgeting among all staff offices.
- Exercise independent, informed judgment in performing a wide variety of administrative, legal, technical, and operational duties, including rating responsibility for five staff offices (Energy Markets, Energy Projects, Enforcement, Litigation and Executive Director’s Office).
Director, Office of Markets, Tariffs and Rates (“OMTR”) (6/99 – 7/05)
- As OMTR director for six years, served as top advisor on legal and technical issues for three FERC Chairmen (James Hoecker (D), Curt Hebert (R), and Pat Wood III (R)). Responsible for all final technical recommendations in all Commission-issued orders within the agency’s jurisdiction (rulemakings and adjudications). Responsible for formation of the newly-initiated OMTR involving the combination of all gas, electric, oil and economic technical staffs (formerly in three separate offices), including selection of key managers across the agency.
- Responsible for implementing respective Chairmen’s policies and views -- regardless of their popularity -- including Order 2000 and Standard Market Design NOPR (industry restructurings) and Commission response to Western energy crisis of 2000/2001.
- Ran largest staff office within the agency (approximately 400 employees), selected key senior staffers who now run technical and legal offices within the Commission, and served as staff interface and liaison with state commissioners.
Senior Counsel and Policy Advisor to Chairman James J. Hoecker (9/98 – 6/99)
- Served as sole personal legal advisor to the Chairman, concentrating on electric issues; helped manage staff transition from Democratic control to Republican control; helped retain key staff during unpopular Commission staff reorganization known as “FERC First.”
Assistant General Counsel - Electric Rates and Corporate Regulation (2/89 – 9/98)
- Responsible for drafting and legal sufficiency of all Commission electric orders including Orders 888 and 889, mergers, and market based rates requests. Built an impressive list of successes in the Courts of Appeal.
- One of two principal architects of the legal justification in Orders 888/889 for functional unbundling of control of interstate transmission facilities from generation facilities, as a remedy to undue discrimination in interstate transmission service.
- Chief legal point of contact for the open access compliance filings of over 100 public utilities.
- Responsible for processing the initial applications of California, PJM, New York and New England for certification as RTOs.
