Shanghai Announcement on Idle Land Registration - 关于上海市开展闲置土地登记的公告

March 4, 2010

Released and effective on January 28, 2010

On January 28, 2010, The Shanghai Bureau of Planning and Land Resource published an announcement which requested the developers to register the idle land by March 22, 2010. The developers may be required to file with the competent authority and explain the reasons why they have not started the construction.

According to the relevant laws and regulations, in the event that a developer does not start development within one year after obtaining the land use right, an idle land fee may be imposed based on 20% of the land grant price. Furthermore, in the worst case, if the delay lasts for more than 2 years, the Land Bureau is entitled to reclaim the land use right without compensation.
