The State Administration of Industry and Commerce (SAIC) on June 5, 2009, issued a circular containing the Procedural Guidelines on Stopping Eliminating and Restricting Competition Behavior by Abusively Using Administrative Power. Unlike the previous circular, which mainly discusses the Investigation of Cases regarding Monopolistic Agreement and Abusive Use of Market Dominance by SAIC, these procedural guidelines emphasize the disposition method if the administrative authorities at different levels eliminate or restrict competition behavior by abusively using the administrative power. The operators are disallowed to have monopolistic behavior by reason of designation or consignment in the name of administrative organizations. This circular will take effect on July 1, 2009.
