Judicial Interpretation of Several Issues on Application of Enforcement Procedures in PRC Civil Procedural Law 最高人民法院关于适用《中华人民共和国民事诉讼法》执行程序若干问题的解释

This Interpretation establishes a mechanism for restricting non-performing debtors from leaving the country.
- If the legal person is a corporation, the legal representative, person in charge, main responsible person or the direct responsible person affecting the performance of the debts will be restricted from leaving the country;
- If the legal person has no or limited civil liability, his/her agent will be restricted from leaving the country;
- Once the legal person performs the debts in full or provides adequate and effective guarantees agreed to by the parties, the court may terminate the restrictions.
